Terms of Service

1. Who We Are

Class of Happiness is a social-emotional learning (SEL) platform for teachers, parents, and students, operated as a digital product and service. By accessing or using the Class of Happiness app, website (classofhappiness.com), or any related services (collectively, the "Service"), you agree to these Terms of Service.

References to "we", "us", or "our" refer to Class of Happiness. References to "you" refer to any individual or institution accessing the Service.

2. Who Can Use the Service — Age, Accounts and Consent

The Service is intended for:

• Teachers and school staff (aged 18 and over)
• Parents and guardians (aged 18 and over)
• Students under the supervision of a parent, guardian, or teacher

Accounts may only be created by adults (18+). Children use Class of Happiness through profiles created and managed under an adult's account — children never create accounts, accept these Terms, or give consent themselves.

Wherever a child's personal data is involved, the necessary consent is given by the holder of parental responsibility, or by the school where the school lawfully acts on parents' behalf, in line with Article 8 of the GDPR. We apply this parent-first approach in every country we operate in, regardless of the local age of digital consent. Schools and organisations agree to obtain necessary parental consents before adding students to the platform.

3. The Service Is a Supplementary Tool — Not a Clinical Service

4. Accounts and Access

To use the Service you must create an account. You are responsible for:

• Keeping your login credentials secure and confidential
• All activity that occurs under your account
• Ensuring that students or family members added to your account are done so with appropriate consent
• Notifying us promptly if you suspect unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe pose a risk to the safety of users, particularly children.

5. Subscriptions and Payment

Class of Happiness offers a free tier and paid subscription plans. Paid plans are billed monthly depending on the plan selected.

• Free trial: New users may access a free trial period using a trial code. Trial periods are subject to change.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for the current period.
• School packages: Institutional packages are governed by a separate agreement and invoiced directly.
• Price changes: We will give reasonable notice of any pricing changes before they take effect.

Payments are processed securely by Stripe. We do not store your payment card details. By subscribing, you also agree to Stripe's Terms of Service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in any way that could harm children or other users
• Share your account credentials with others outside your household or institution
• Upload or transmit any content that is harmful, abusive, or inappropriate
• Attempt to reverse-engineer, copy, or reproduce any part of the Service
• Use the Service to collect data about users without authorisation
• Misrepresent your identity or affiliation when using the Service

7. Creature Submissions and Other User Content

Class of Happiness lets students create and submit original creature designs ("Creature Submissions") and other content such as check-in notes and messages (together, "User Content").

Your creations stay yours. Class of Happiness does not claim ownership of User Content. Every creature a child designs belongs to that child and their family.

The permission you give us. So the app can work, the adult responsible for a profile (a parent, guardian, or authorised school staff member) gives Class of Happiness permission (a worldwide, non-exclusive, royalty-free licence) to host, store, display, adapt for display (for example resizing, or creating evolution stages), and share User Content within the Class of Happiness app and portal, for as long as the content remains on the service. We do not use children's creations in advertising or marketing.

Children and consent. Children do not create accounts or accept these Terms themselves. Creature Submissions from a child's profile are only accepted where the linked parent/guardian account — or, for school-managed profiles, the responsible school — has accepted these Terms on the child's behalf.

Community creatures. Approved Creature Submissions may appear in classroom, school, or global creature collections where other users can see and collect them. Community creatures are shown with the submitting profile's display name only — never a child's full name, photo, school, or any other identifying detail.

Moderation. Every Creature Submission is reviewed before it appears anywhere. We may decline or remove any User Content at any time if we consider it inappropriate, unsafe, infringing, or inconsistent with the wellbeing purpose of Class of Happiness. Moderation decisions are final.

Content rules. User Content must never include: personal details (full names, addresses, phone numbers, school names, faces or photos of real people); violent, sexual, hateful, or discriminatory material; copies or imitations of characters, brands, or artwork belonging to others; or anything intended to upset, frighten, or bully. Accounts that break these rules may lose submission privileges. See our plain-language Child Safety & Content Rules.

Removing content. You can ask for any Creature Submission to be removed at any time from within the app or by emailing jono@classofhappiness.com. When a family account is deleted, that family's Creature Submissions are removed from community display within 30 days and permanently deleted, unless the law requires us to keep a copy. For school-managed profiles, content connected to school records may be retained until the school directs its deletion, in line with our agreement with the school.

Your promise to us. Whoever submits User Content confirms it is the original work of the submitting child or family and doesn't copy anyone else's work.

8. Intellectual Property

All content within the Service — including the app, website, portal, Emotions Program materials, worksheets, the original emotion creatures and their names, artwork, animations and evolution stages, strategies, all voice and audio recordings in every language, and branding — is original content owned by Class of Happiness and protected by copyright and other intellectual property rights. All rights are reserved. Nothing in these Terms transfers any Class of Happiness intellectual property to you.

• You may use the Service and downloaded materials as intended, for personal or educational use within the school or family they were provided to
• You may not reproduce, resell, redistribute, adapt, or build derivative products from our content without prior written permission
• Class of Happiness is not affiliated with, endorsed by, or related to any third-party SEL frameworks or registered trademarks

9. Limitation of Liability

To the fullest extent permitted by applicable law, Class of Happiness shall not be liable for:

• Any indirect, incidental, or consequential damages arising from your use of the Service
• Any outcomes relating to a child's emotional wellbeing arising from use of the Service
• Any interruptions, errors, or data loss resulting from technical failures
• Any content uploaded by users that is inaccurate, harmful, or inappropriate

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding fitness for a particular purpose.

10. Safeguarding and Child Safety

Child safety is a core priority. If you become aware of any content or behaviour within the Service that raises a child protection concern, please contact us immediately at jono@classofhappiness.com. We will act promptly in accordance with applicable safeguarding obligations.

Schools using the Service remain responsible for their own safeguarding policies and for ensuring appropriate use of the platform within their institution.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will notify users via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Portugal and the European Union. Any disputes arising from use of the Service shall be subject to the jurisdiction of the courts of Portugal, without prejudice to your rights as a consumer under the laws of your country of residence.
